IMPORTANT NOTICE
This Privacy Policy includes the ubthd RealTalk Terms of Use, which govern acceptable use of the Service. Additional terms related to subscriptions, billing, arbitration, and limitation of liability are set forth in the RealTalk Premium Subscription Terms & Conditions.
In the event of any conflict between this Privacy Policy and the Subscription Terms, the Subscription Terms shall control with respect to billing, arbitration, liability, and dispute resolution.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to the practices and terms described in this document.
1. Definitions
For purposes of this Privacy Policy and Terms of Use:
• “Company,” “we,” “us,” or “UBTHD” means UBTHD LLC, the owner and operator of the Service.
• “RealTalk,” “Service,” or “Platform” means the ubthd RealTalk application, website, AI systems, workflows, and related features.
• “User,” “you,” or “your” means any individual who accesses or uses the Service.
• “User Content” means any information, text, messages, uploads, or other content submitted to the Service by a User.
• “Subscription Terms” means the RealTalk Premium Subscription Terms & Conditions.

2. Who We Are
UBTHD operates ubthd RealTalk, a self-guided, AI-powered reflection and support tool designed to help users gain emotional clarity, organize personal goals, recognize patterns about themselves and the systems around them, and reconnect with trusted people in their own lives.
This Privacy Policy explains how we collect, use, store, and protect information when you use the Service.
3. Important Disclaimer (Read Carefully)
RealTalk is not a medical service, therapy platform, crisis intervention tool, or diagnostic system.
The Service does not provide:
• therapy or counseling
• medical or mental health advice
• diagnosis
• emergency or crisis services
RealTalk is intended solely as a self-guided reflection and support tool.
If you are experiencing a mental health emergency or are in crisis, contact 988, a licensed professional, or local emergency services immediately.
You acknowledge and agree that:
• the Service is not a substitute for professional care
• you are responsible for decisions you make based on use of the Service
4. Eligibility
The Service is intended for individuals 18 years of age or older.
UBTHD does not knowingly collect personal information from individuals under 18. If such information is discovered, it will be deleted.
5. Information We Collect

b. Emotional Goals & Reflections
• Selected emotional goals
• Custom entries and reflections
• Progress tracking data
c. Contact Log (Third-Party Information)
You may optionally store names and phone numbers of trusted contacts you personally choose.
You represent and warrant that:
• you have permission to store this information
• you will not use the Service to violate another person’s privacy
UBTHD does not contact these individuals.
This information is stored solely for your personal organization and reference.
d. User Content & Interactions
• Messages exchanged with the Service
• Optional uploads such as screenshots or text
e. Subscription & Payment Information
Payments are processed by Shopify and Stripe.
UBTHD does not store payment card information.
6. How We Use Information
We use information to:
• operate and maintain the Service
• personalize reflections and prompts
• track emotional goals and patterns
• suggest trusted contacts you may choose to reach out to
• manage subscriptions and access
• improve system performance, safety, and reliability
7. AI Processing Disclosure
The Service uses automated systems and artificial intelligence to generate responses and reflections.
You acknowledge and agree that:
• outputs are generated algorithmically
• responses may be incomplete, inaccurate, or inappropriate in some contexts
• AI-generated outputs should not be relied upon as professional advice
UBTHD does not guarantee the accuracy, completeness, or applicability of any AI-generated output.
The Service does not monitor User Content for crisis indicators, self-harm risk, or emergency situations, and UBTHD has no obligation to intervene, contact authorities, or notify third parties based on User Content.
8. Data Storage & Security
UBTHD implements reasonable administrative, technical, and organizational safeguards, including:
• encrypted data transmission (HTTPS)
• hashed passwords
• access controls limiting data to authenticated users
• secure hosting, monitoring, and backups
No system is completely secure, but data protection is taken seriously.
9. Data Retention & Deletion
Personal data is retained only as long as reasonably necessary to:
• operate the Service
• comply with legal obligations
• resolve disputes
• maintain security and integrity
Deletion requests may not result in immediate or complete removal due to:
• backups
• legal or regulatory requirements
• fraud prevention
• system integrity needs

13. Purpose of the Service
RealTalk is designed to support emotional reflection, personal clarity, pattern recognition, and reconnection with trusted people. It is a supportive AI tool, not a diagnostic service, crisis resource, or replacement for therapy or human connection.
14. Acceptable & Ethical Use
You agree to use the Service responsibly and in alignment with its intended purpose.
You are responsible for:
• the accuracy of information you provide
• maintaining the confidentiality of your credentials
• your decisions and actions resulting from use of the Service
15. Prohibited Use
You may not use the Service to:
• harass, harm, or exploit others
• upload illegal, abusive, or privacy-violating content
• impersonate others
• attempt to reverse engineer or misuse the platform
• circumvent subscription or access controls
16. Emotional Boundaries
The Service is not a substitute for:
• therapy or counseling
• medical advice or diagnosis
• crisis support or emergency services
If you are in crisis, contact 988 or emergency services immediately.
You agree not to rely on the Service as the sole basis for decisions involving personal safety, health, or well-being.
17. Intellectual Property
All branding, software, prompts, workflows, and design elements of RealTalk are the intellectual property of UBTHD LLC.
No portion of the Service may be copied, reproduced, distributed, or exploited without prior written consent.
18. Subscription Access
Premium access is governed by the RealTalk Premium Subscription Terms & Conditions.
You agree not to share access credentials or attempt to bypass subscription controls.
19. Termination
UBTHD may suspend or terminate access for violations of these Terms, misuse of the Service, or unethical behavior.
20. Limitation of Liability
The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, UBTHD LLC is not liable for emotional, psychological, personal, or financial outcomes resulting from use of the Service.
You acknowledge that reflecting on emotional experiences may be uncomfortable or distressing and agree that you voluntarily assume these risks.
21. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida.
Dispute resolution, arbitration, class action waivers, and jury trial waivers are governed by the Subscription Terms, which are incorporated by reference.

23. Entire Agreement
